1.  Introduction

Mass Media Labs LLC (“Agency,” “we,” “us,” or “our”) is committed to protecting the privacy and confidentiality of information shared with us by our clients, prospective clients, and their customers. This Privacy Policy describes how we collect, use, store, and protect information in connection with the marketing services we provide.

This Privacy Policy applies to (a) information provided to us by clients who engage our services, (b) information about the end consumers of our clients whose data we access or process as part of service delivery, and (c) information collected through our website or business communications.

By engaging Mass Media Labs LLC or signing a service agreement with us, you acknowledge that you have read and understood this Privacy Policy.

2.  Information We Collect

In the course of providing our services, we may collect and process the following categories of information:

2.1  Client Business Information

We collect information provided directly by our clients in order to perform services, including:

  • Business name, address, phone number, and email address
  • Business owner and manager names and contact details
  • Brand assets, including logos, color palettes, fonts, and brand guidelines
  • Product or service information and marketing history
  • Financial information necessary for billing and invoicing
  • Login credentials and permissions for platforms we manage on the client’s behalf (such as Brevo)

2.2  Contact List Data (Client Customer Data)

Clients may provide us with contact lists containing their customers’ or subscribers’ information for the purpose of executing email and SMS campaigns. This data may include:

  • Names
  • Email addresses
  • Phone numbers
  • Customer segmentation data (purchase history, tags, engagement scores, )

Mass Media Labs LLC processes this data exclusively as a service provider acting on behalf of and at the direction of the client. We do not own this data, and we do not use it for any purpose other than delivering the agreed-upon services.

2.3  Campaign Performance Data

We collect and analyze performance data generated by campaigns executed on behalf of our clients through Brevo and other tools. This includes open rates, click-through rates, unsubscribe rates, bounce rates, and other engagement metrics. This data is used solely to optimize campaign performance and provide reporting to the client.

2.4  Website & Communications Data

If you contact us through our website, email, or other channels, we may collect your name, email address, phone number, company name, and the content of your message. This data is used to respond to inquiries and manage our business relationship.

3.  How We Use Information

We use the information we collect for the following purposes:

  • To deliver email and SMS marketing services as outlined in our service agreements
  • To set up and manage marketing platforms and automations on behalf of clients
  • To analyze campaign performance and provide reporting and recommendations
  • To communicate with clients regarding their accounts, projects, and deliverables
  • To process billing and payments
  • To comply with applicable legal obligations, including email and SMS marketing compliance requirements
  • To protect the rights, property, or safety of Mass Media Labs LLC, our clients, or others

We do not sell, rent, lease, or otherwise disclose client information or client customer data to third parties for marketing or commercial purposes.

4.  Third-Party Platforms & Service Providers

In performing our services, we access and operate within third-party platforms on behalf of our clients. The primary platform we use is:

4.1  Brevo (Email & SMS Platform)

Mass Media Labs LLC is an Agency Partner with Brevo. All email and SMS marketing campaigns are executed through the Brevo platform. When we access a client’s Brevo account, we operate under the permissions granted by the client. Data stored within Brevo, including contact lists and campaign data, is subject to Brevo’s own Privacy Policy and Terms of Service. Clients are encouraged to review Brevo’s policies at www.brevo.com.

4.2  Other Tools

We may use additional tools for project management, communication, reporting, or analytics. We take reasonable steps to ensure that any third-party tools we use maintain appropriate data privacy and security standards. We do not share client data with third-party tools beyond what is necessary to deliver agreed-upon services.

5.  Data Retention

We retain client business information and related data for as long as necessary to fulfill our service obligations and for a reasonable period thereafter for recordkeeping purposes, typically no more than 3 years following the end of a client engagement, unless a longer period is required by law.

Client customer data (contact lists and related records) will be securely deleted or returned to the client upon termination of the applicable service agreement, or upon written request by the client, within thirty (30) days of such request.

6.  Data Security

Mass Media Labs LLC implements commercially reasonable technical, administrative, and organizational measures to protect the information we hold from unauthorized access, disclosure, alteration, and destruction. These measures include:

  • Secure storage and limited internal access to client data
  • Use of password-protected and access-controlled platforms
  • Agency-level account access via Brevo’s permissioned partnership model
  • Confidentiality obligations applicable to any contractors or personnel involved in service delivery

However, no method of data transmission or storage is completely secure. While we strive to protect client information, we cannot guarantee absolute security. In the event of a data breach that is likely to affect client data, we will notify the affected client(s) as promptly as practicable and in accordance with applicable law.

7.  Client Responsibilities Regarding Contact Data

Because Mass Media Labs LLC processes contact data on behalf of our clients, the client serves as the data controller for their customer and subscriber data. As such, the client is solely responsible for:

  • Ensuring that all contact data provided to Mass Media Labs LLC was collected with proper prior express consent in compliance with the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and applicable Texas state laws
  • Maintaining records of consent for all contacts in their marketing lists
  • Honoring opt-out and unsubscribe requests promptly and in accordance with applicable law
  • Ensuring that their collection and use of customer data complies with their own privacy policy and any applicable privacy regulations

Mass Media Labs LLC shall not be liable for any privacy violations, regulatory penalties, or third-party claims arising from the client’s failure to maintain compliant contact data or consent records.

8.  Texas Privacy Law Considerations

Mass Media Labs LLC operates in and is governed by the laws of the State of Texas. We are aware of and take steps to comply with applicable Texas privacy and marketing laws, including:

  • Texas Business & Commerce Code Chapter 321, governing unsolicited commercial email
  • Texas Business & Commerce Code Chapter 305, governing telemarketing and SMS marketing practices

Clients are advised that individual recipients located in other states or countries may be subject to additional privacy laws (such as the California Consumer Privacy Act (CCPA) or the European Union’s General Data Protection Regulation (GDPR)). Clients operating in or targeting consumers in these jurisdictions are responsible for ensuring their own compliance with those applicable laws. Mass Media Labs LLC does not represent or warrant compliance with CCPA, GDPR, or other non-Texas privacy regimes on behalf of clients.

9.  Children’s Privacy

Our services are not directed to individuals under the age of 18, and we do not knowingly collect personal information from minors. Clients warrant that their marketing lists do not include individuals under the age of 18 without appropriate parental or guardian consent where required by law.

10.  Updates to This Privacy Policy

Mass Media Labs LLC may update this Privacy Policy from time to time to reflect changes in our practices, services, or applicable law. We will notify active clients of material changes via email or written notice. The “Effective Date” at the top of this document indicates when the most recent version took effect. Continued engagement with our services following notice of an updated Privacy Policy constitutes acceptance of the revised terms.
